About this website
This website is operated by Motor Claim Management Pty Ltd (ABN 87 660 165 104), trading as MotorClaim Accident Management, servicing the Greater Sydney Area.
The information here is general
Everything on this site is general information about what we do. It is not legal advice and it is not advice about your insurance policy. Whether you are entitled to a replacement vehicle, and on what terms, depends on the circumstances of your accident and on the policies involved. We assess every case individually and tell you where you stand before anything is arranged.
A free initial consultation may be available through EXC Law Pty Ltd, subject to eligibility and the firm's engagement terms. Further legal work and fees are governed by the firm's costs disclosure and agreement. This website is general information, not legal advice. Depending on your insurance policy and how the claim is managed, you may be entitled to choose a licensed repairer. We can coordinate with Crash Solutions P/L or an eligible repairer you nominate and explain any restrictions before booking.
At no cost to you - what that means
If you are eligible and liability is accepted or established, we seek recovery of reasonable towing, repair and replacement-vehicle costs from the at-fault party or insurer. Recovery is not guaranteed. We explain your obligations, including what may happen if recovery is unsuccessful, before you sign. For an eligible not-at-fault claim, a $0 excess arrangement may be available. For an at-fault claim, where your policy allows repairer choice and we carry out the repairs, our excess waiver or contribution of up to $1,000 is assessed and confirmed before work begins. The rental agreement separately sets out vehicle-use obligations, applicable damage excess and handling fees, tolls, infringements and return requirements.
This is assessed case by case and confirmed with you before anything is arranged. If you take a replacement vehicle, the rental agreement you sign sets out your obligations, including the excess and handling fee that applies if the vehicle is damaged while it is in your care. We go through that agreement with you before you sign it, and you keep a copy.
A comparable replacement vehicle suited to your reasonable needs, subject to eligibility and availability. You may keep the replacement vehicle for the reasonable repair or total-loss settlement period, subject to the rental agreement and ongoing eligibility. Contact us before the agreed return date if you need more time; an extension must be agreed.
MotorClaim does not charge for fuel used or a difference in fuel level on return. Tolls are charged to the renter and infringement notices are transferred into the renter's name under the rental agreement. This website summary does not replace the agreement you sign.
Using the forms
Please give us accurate information. Claims are lodged with insurers on the basis of what you tell us, and an inaccurate report can put your claim at risk. The Authority to Act must be completed and signed by the registered owner of the vehicle personally.
Do not use the forms to send us anything you are not entitled to send, and do not attempt to interfere with the site or with other people's claims.
Availability
We aim to keep the site available at all times, but we do not guarantee it will always be reachable or error-free. If the site is down and you need help, call 1300 255 588 - the phone is answered 24 hours a day.
Your rights under Australian Consumer Law
Nothing on this website excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
